Terms & Conditions
Last updated: 15 October 2026
These terms explain how BAY Custom Studios handles bookings and purchases. Read them alongside the description or quotation for your chosen service or product, and contact us if anything is unclear before paying. Nothing here limits your statutory rights.
1. Who You Are Booking With
BAY Custom Studios is the trading name of BAY CUSTOM STUDIOS LIMITED, registered in England and Wales under company number 16058699.
Registered office: 23 Wood Lane, Wedges Mills, Cannock, Staffordshire, England, WS11 1SZ.
Email: info@baycustomstudios.com
Telephone: +44 7930 090039
“We”, “us” and “our” mean BAY CUSTOM STUDIOS LIMITED. “You” means the customer making the booking or purchase. If acting for another person or organisation, you must have authority to do so.
2. Your Booking & Agreement
These terms apply when provided before you book our services or purchase our digital products. The relevant description or quotation, selected extras and any specific conditions agreed before purchase also form part of the agreement. Together, they set out the work or product, price, deliverables, requirements and schedule.
For a fixed-price online purchase, the order is confirmed when payment succeeds. For bespoke work, the quotation explains how to accept it and any payment needed to confirm the booking. Payment alone does not mean that work starts immediately. Please check your details and tell us promptly about any error.
We will email a confirmation containing the agreed booking details and a copy of these terms that you can keep. Later website changes do not alter that agreement. Any specific variation must be agreed with you and cannot remove mandatory consumer rights.
3. Prices & Payment
The price, currency, selected extras and payment arrangements are shown before you commit. Any deposit, instalments or balance due will be specified in the offer or quotation. BAY CUSTOM STUDIOS LIMITED is not VAT registered and does not add VAT to the stated prices.
Extras are optional unless clearly included in the agreed service. We will not add charges or apply a later price increase to an existing booking without your agreement. Your payment provider may charge for currency conversion if you pay from an account in another currency.
4. Services & Deliverables
Your chosen service description or quotation specifies the services included, project size, versions, delivery formats and any revision allowance. A provision offered in one package does not automatically apply to another booking.
Recording, production, editing, mixing and mastering are distinct services and are included only as described or agreed. For studio sessions or residential projects, the quotation also identifies the location, booked facilities, dates and any accommodation or other arrangements. Relevant additional conditions are supplied before you book.
5. Additional Services & Changes
If you need more tracks, alternative versions, additional formats or other work outside the agreed scope, we will confirm the extra cost and any effect on the schedule before proceeding. Session musicians, hired equipment and other separately arranged services are subject to availability and the arrangements agreed with you. We will not commit you to an additional cost without your agreement.
6. Files & Project Information
Provide an accurate brief and follow the preparation requirements for the service you have booked. For work using files you supply, those requirements explain the necessary formats and preparation. Please raise uncertainties before booking and tell us about any essential technical or creative requirements.
We will check supplied material and explain any missing or unsuitable files before the affected work proceeds. You may need to correct or replace them, and we will discuss any resulting schedule change. If the problem cannot be resolved, we will explain the available options and any cancellation or refund due. Unsuitable files do not automatically make a payment non-refundable.
7. Revisions & Approval
The revision arrangement is stated in your offer or quotation. Where rounds are included, a round means one consolidated set of feedback followed by an updated version; the initial version is not a revision round. Feedback should relate to the agreed brief and the stage under review.
New material, a changed brief or reopening an approved stage may require additional work. We will agree its scope, cost and timing with you first. Where approval is required, silence is not approval. Corrections needed because our work fails to meet the agreed brief or specification do not use up creative revision allowances or limit your statutory remedies.
8. Start Dates & Turnaround
The offer or quotation sets out the expected start and turnaround for your project. Timing reflects the services, number of tracks, complexity and studio availability; a timing advertised for one package does not automatically apply to a larger or different project. Please have any essential deadline confirmed before booking.
Work proceeds in line with the agreed schedule once the necessary material, brief and any required early-start request are in place. Feedback, revisions and approvals affect progress between stages and final delivery. We will tell you about delays and discuss a revised schedule or other appropriate resolution. If no completion time is agreed, services will be performed within a reasonable time. Your rights concerning delay or non-performance remain unaffected.
9. Delivery & Checking Your Files
We deliver the agreed files or products by the method stated for your booking or purchase. Keep your contact details accurate and tell us if instructions or delivery do not arrive. Please check audio, file names and relevant metadata before release or manufacture, and report problems promptly so we can help.
Tell us before preparation if your distributor, manufacturer or cutting engineer requires a particular specification. Additional work outside the agreed deliverables will be quoted separately; correcting our failure to meet an agreed specification is not a paid extra.
10. Consumer Cancellation & Early Start
For most services booked online or at a distance, consumers have 14 calendar days to cancel without giving a reason, starting the day after the contract is made. A consumer is an individual acting wholly or mainly outside their trade, business, craft or profession. Additional mandatory rights remain unaffected. Any applicable exception, such as certain fixed-date accommodation bookings, will be explained before purchase. Digital-product cancellation is addressed in Section 14.
Tell us clearly that you wish to cancel before the period expires. You can email info@baycustomstudios.com, write to the address in Section 1 or use the optional model form in Section 18. These are convenient methods, not restrictions on any other legally valid cancellation notice. Your name and booking reference help us identify the order.
Starting During The Cancellation Period
We need your separate express request before starting a service during this period. Accepting general terms or sending files is not that request. Without it, we arrange the start after the cancellation period.
If you request an early start and later cancel, you may have to pay a proportionate amount for work actually provided, where the legal conditions are met. The change-of-mind right ends only when the service is fully performed, provided you expressly requested the early start and acknowledged that consequence. Rights concerning faulty or incorrectly supplied work remain unaffected.
Refunds Following Cancellation
We make statutory cancellation refunds without undue delay and within 14 days of receiving your cancellation, using the original payment method unless you expressly agree otherwise. There is no refund fee or deduction of the payment processor’s fee from a statutory full refund. Any lawful charge for work already provided will be explained.
11. Other Cancellations & Uncompleted Work
If you need to cancel or rearrange outside a statutory cancellation period, or you booked as a business, contact us promptly. We will explain any reasonable amount properly due for work completed or demonstrable, unavoidable loss, accounting for costs saved and loss we can reasonably avoid. We do not automatically retain full payment, charge twice for the same loss or treat inactivity as approval or forfeiture.
If we cannot provide the agreed service, we will discuss alternatives or cancellation and refund any amount due. You will not have to accept credit instead of a refund to which you are entitled. Other legal remedies remain available.
12. Your Music, Permissions & Confidentiality
You are responsible for the permissions needed to use material you supply, including recordings, performances, compositions and samples. You retain any ownership rights you already have in that material and allow us to access, copy and process it as needed to deliver and administer the project, including through relevant service providers.
Any separate ownership or licensing arrangements for new creative contributions will be agreed before the relevant work is commissioned. You may release the delivered masters subject to those arrangements and the rights in the underlying material.
We treat unreleased project material as confidential. Booking does not give us permission to publish it or use it in advertising or a public portfolio; that requires separate appropriate permission. Necessary project processing and disclosures required by law are not prevented by this commitment.
13. File Retention & Backups
Please download and securely back up your delivered files. Unless separate storage is agreed, we are not a permanent archive. In line with our Privacy & Cookie Policy, raw recordings, session files and working versions are normally retained for at least 90 days after final delivery or project completion, whichever is later. Final deliverables are normally retained for at least 12 months from that point.
Longer retention may be appropriate for an ongoing lawful reason but is not guaranteed. After the relevant period, files may be securely deleted without further notice, subject to legal obligations and data-protection rights.
14. Separately Purchased Digital Products
Each digital product’s description explains its content, price, delivery, relevant technical requirements and permitted use. Any specific licence is provided before purchase. Buying a product does not itself transfer copyright or permit redistribution of its original files.
Consumers purchasing downloadable digital content normally have 14 days to cancel, starting the day after the contract is made. Before supplying it during that period, we obtain any required express consent to immediate supply and acknowledgement that the cancellation right will be lost when supply begins. We confirm this in a form you can keep; general terms acceptance alone is not enough. Without that consent, supply is arranged after the cancellation period. See Section 10 for how to cancel and statutory refunds.
Rights concerning faulty or misdescribed digital content remain unaffected. A personally performed recording, production, mixing or mastering service is not treated as an instant-download product simply because its finished files are delivered digitally.
15. Service Standards & Problems
We perform services with reasonable care and skill, in line with the agreed description and brief. Tell us if something appears incorrect so we can investigate and resolve it. These terms do not restrict applicable rights to corrective work, a price reduction, a refund or other remedies.
Nothing here excludes liability that cannot lawfully be excluded, including liability for fraud or death or personal injury caused by negligence.
16. Privacy & Communications
Our Privacy & Cookie Policy explains how we handle personal information, transactions and project material. We use booking details to administer and deliver your purchase. Buying from us does not automatically subscribe you to our mailing list.
17. Complaints, Applicable Law & Changes
Send complaints to info@baycustomstudios.com with your booking reference and the issue. We aim to reply within one working day and keep you informed. If unresolved, we will provide information about applicable alternative dispute-resolution routes as required by law.
These terms are governed by the law of England and Wales, without removing mandatory consumer protections or access to courts available to you under applicable law, including where you live. Updates apply to future purchases, not retrospectively to existing agreements without your consent or a legal requirement.
18. Optional Model Cancellation Form
Complete and return this only if you wish to cancel. Any other clear cancellation statement is also acceptable. No handwritten signature is needed for an email cancellation.
